It would be a zoo out on the street, and the neighbours will almost certainly find out what is going on. In their eyes he'll be guilty regardless.

The story insinuates that just having sexually explicit dialogue with a minor online is illegal, and that's what they were going to bust him for at his house.

Is that the law? If so, then it'd make sense.

The Wyatt Law Office has represented suspects in some of these operations and many other cyber investigations. With the proliferation of the Internet, criminal complaints involving cybersex and cyber crime will likely involve allegations of crossing state lines for sexual purposes; possession, distribution or manufacturing of child pornography; and/or lewd or indecent proposals to minors via the World Wide Web (i.e., the "Internet"), bulletin board systems, Internet relay chat, Web-based chat, messengers, electronic mail (e-mail) and Usenet or news groups; lewd molestation or sexual exploitation of minors; promoting prostitution; traveling to engage in sex with a minor, interstate communication to entice a minor to engage in sex, and even trafficking in children for sexual purposes or pornography.

If you are under investigation or are charged with any of htese crimes, the Wyatt Law Office can help you.

Got this from a lawyer site so it seems that it is illegal to have sexually explicit conversions with a minor. I doubt there is much of a punishment for it, and I assume the attempt to lure these guys to the house is to get them up on much greater charges.

What if the guy that tracked down was just acting out a fantasy? I came across this:

http://www.netaddiction.com/articles/eia_pedophilia_profile.htm

Down the page it talks about people who are just enacting a fantasy. Sure society isn't going to approve of people fantasing about minors, but is it worth the same punishment as actually turning up to have sex with one? Furthermore, how would he even know that the person is actually a minor? It's not unreasonable to assume that it may just be someone else fantasising about being a kid and having an adult take advantage of them.

I haven't seen the chats and I don't approve of what the guy likely did in the first place, but these people are clowns.

“In a quasi-related case during the serving of search and arrest warrants on those who did not arrive, Assistant District Attorney Louis W. Conradt Jr., of Rockwall County, Texas. was one of the individuals during the sting that solicited one of our decoys sexually,” the web site stated. “While he did not come to the sting house, his home along with others was served by search and arrest warrants...It is unfortunate that he chose this end rather than to have his day in court.”
Police forced their way into Conradt’s Terrell home after hearing a gunshot when he refused to answer the door, a police spokesman said. The officers found Conradt with a self-inflicted gunshot wound. He later died at a hospital in Dallas, about 30 miles west of Terrell.

Police in the town of Murphy in nearby Collin County said Conradt had solicited sex from a decoy posing online as a 13-year-old. Murphy police were attempting to serve an arrest warrant and a search warrant for Conradt’s computer when he shot himself, Murphy Police spokesman Sgt. Snow Robertson said.

Let's just hope that he set a precedent and other child molesters will follow his lead, and I don't mean by filing lawsuits either.

There's scant evidence he was a "child molester" since all of the cited online chats were between him and another 30+year old adult.

i bet he sent explicit pics of himself, that was often the case in they're setups

If so, he in fact sent those explicit pics of himself to other adults - not to minors.

you can get charged, not me. you're the one transmitting pornographic material to a minor

In this case, the alleged pornographic material was transmitted to other adults and not to minors.

Unfortunately, as the TCAP videos prove without question, all of the online chat took place between dude and another adult.

The "minor" was an utter fiction and he is thus being pursued for having explicit chat with an Imaginary Minor.

Holy Cow.

I'm assuming he believed he was chatting online with a minor. It doesn't matter if the person was an adult or not, it's the intent that was illegal.

So if I have sex with my young 21 year old girlfriend and we role play that she's a 16 year old, have I commited child molestation?

Well yeah.

Thus the absolute insanity of much of our criminal justice response to the very real problems in our society of adults having sex with underage minors.

We're now arresting someone for "imagining" sex with a minor.

Apples and oranges barman. You for a fact know that you're girlfriend is 21. These people who commit these crimes actually believe they are online with a minor.

Have you seen some of these turds online? They believe they are talking with a minor. They believe the person is 13, 14, or whatever. They have the intent to commit a crime when they knowingly talk about having sex with them or sending obscene pictures of themselves to them. It's not imaginary to them.

This is not some sexual fantasy site where you log in with other adults and pretend you're a minor, a nurse, whatever. These people are purposely looking for underage kids to have sex with, that's the difference.

They may well be looking for minors, but in truth they've (in these cases at least) only found another adult.

I guess I'm glad I don't have such imaginary fantasies, because it would suck to be imprisoned solely for the thoughts in my mind when no real human being of any age has been harmed.
