Every prisoner of war, when questioned on the subject, is bound to give only his surname, first names and rank, date of birth, and army, regimental, personal or serial number, or failing this, equivalent information. If he wilfully Article 17 privileges accorded to his rank or status.


Why USA is still interrogating prisoners in Guantanamo even it's not allowed. What for?


Article 103

Judicial investigations relating to a prisoner of war shall be conducted as rapidly as circumstances permit and so that his trial shall take place as soon as possible. A prisoner of war shall not be confined while awaiting trial unless a member of the armed forces of the Detaining Power would be so confined if he were accused of a similar offence, or if it is essential to do so in the interests of national security. In no circumstances shall this confinement exceed three months.


Three months! I think time has passed in Guantanamo.
I don't know about Afgan soldiers, but at least USA should release all prisoners from other countries.

AND DON'T SAY THAT PRISONERS IN GUANTANAMO ARE NOT POW. USA SAYS THAT, BUT OTHER COUNTRIES SAYS THEY ARE POW.

This whole conversation started after Mr. Rumsfeld said Iraq doesn't respect Geneva convention article 13. He is correct about that, but USA doesn't respect that either. And who gave rights to attack to Iraq? Not UN, I think.

The Geneva Convention has nothing to do with the UN. It came about decaeds before the creation of the UN.

The Guantanamo Bay detainees are NOT POW's. They are private citizens of various countries who have commited or conspired to commit crimes against the US and US citizens. We aren't at war with Pakistan, Saudi Arabia, Algeria, etc. They aren't soldiers of those countiry's military forces. There's no war so they aren't prisoners of WAR. They aren't located on US soil therefore US laws do not apply.

You may or may not agree with the fact that they are being detained like they are but that doesn't change their LEGAL status. It's a black and white issue.

This Geneva convention is dated 1955 and some additions have made after that. I only wanted to say that USA doesn't respect UN or Geneva convention. Why to expect Iraq respect those things after USA have attaced without any rights to Iraq?

USA attacked to Afganistan took those prisoners from Afganistan. I think it was a war it doesn't matter where those prisoners are coming from (correct if I'm wrong. You have Geneva convention link). Crimes against US citizens, what a crap. Those shitheads in Afganistan (Taliban soldiers) made crimes against Afgan civils, but not against USA or its citizens.
