Easement HELP

My Daughter that Lives Kentucky has a Problem , The Sanitation Department wants to run a PIPE NEAR her house under ground , They are taking her trees out fence out Digging the whole side of the yard up . This pipe is coming from the Street above them . They said the Pipe will be 5 feet from the house . Need someone to help out on this matter Please.... Thank you ..

Do they have an easement already or are they asking for one now? Is this replacing an existing pipe? Does it service her house? I am a Florida real estate lawyer, not a Kentucky lawyer.

You can check the title to the property to see if the sanitation department has an easement. If there is one then the sanitation department is within their rights to do so. Maybe see if you can get a free consultation from a local lawyer. It sucks but I don't think there is much you can do.

No this the only one . They want to bring a pipe down a hill in here back yard down the side yard out to the street

I asked the questions he needs to answer. If they have a title policy, check the policy exceptions to see if there is an easement listed.
