Stallworth's toxicology report could take a week

MIAMI BEACH, Fla. — Miami Beach police are awaiting the toxicology report for Cleveland Browns wide receiver Donte Stallworth before releasing information into his car accident that killed a pedestrian.
Police spokesman Juan Sanchez said Monday that the routine blood work had not made it to the lab yet. Sanchez said results are expected to be released by the end of the week.
Authorities said Stallworth was headed toward the beach when he hit 59-year-old Mario Reyes with his Bentley on Saturday morning on a busy causeway linking Miami and Miami Beach.
Stallworth was cooperating with police and no charges have been filed. A message seeking comment was left on the voicemail of his agent, Drew Rosenhaus.

Stallworth says in a statement released by the team Wednesday that his “thoughts and prayers are with” the family of Mario Reyes. Police say Stallworth was headed toward the beach when he hit the 59-year-old Reyes with his Bentley on Saturday morning. Reyes was near a crosswalk but it’s unclear if he was crossing legally.
Stallworth said he could not comment further because the accident is under investigation. He was cooperating with police and no charges have been filed.
Police are awaiting a routine toxicology report expected late this week before releasing more details.

WSTN in Miami reports that Donte' Stallworth had a blood-alcohol level of 0.12 when his vehicle collided with pedestrian Mario Reyes last weekend, killing Reyes.
The legal limit in Florida is 0.08. Stallworth's attorney and Miami police will not confirm the report. The police says the final toxicology report is not due until Friday. If the report proves accurate, police could charge Stallworth with DUI manslaughter, a felony calling for up to 15 years in prison.

sounds like Donte was drunk. Had a .12 when the legal limit is .08 in Florida. If so, he should be punished to the fullest extent of the law

You took the words right out of my mouth. How much does it cost to hire a driver for a night ($100-$300). Now the guy is going to prison, will loose his $35 million dollar contract and has ruined an innocent family. Sad story.

Agree assuming Dante was at fault (He probably was)

Disagree if the guy ran across the street at a green light, was laying on the road in black clothes, etc.

99% says it was Dante's fault, but having some beers first should not auto make you guilty.

I am very much against drunk driving, but I do believe if you have 4 beers and someone decides to jump on your hood, you should just get the normal dui.

On the other hand if the guy is in a crosswalk, he should get 15 years

well from everything that's come out so far, it doesn't seem like the pedestrian at fault. Just from what's come out.

Nonetheless, he shouldn't be out drinking and driving. I'm sure he had more than 4 beers. it was 7am when he hit him. Probably drinking all night long.

He can well afford the best lawyer and get reduced charges and reduced sentence. If the pedestrian was jaywalking I would think the manslaughter charge would be thrown out.

I hope the lawyers get 35 million out this fool if he gets off light. I would fire his ass. As stated above get a driver you have the means for sure no excuse for this guy driving drunk.

MIAMI -- Cleveland Browns wide receiver Donte' Stallworth was driving drunk when he struck and killed a pedestrian, according to published and broadcast reports Thursday. WSVN-TV reported Thursday that unnamed sources with knowledge of the investigation said Stallworth's blood-alcohol level was between .08 and .16. The legal limit is .08. The Miami Herald also cited an unnamed source as saying that Stallworth's blood-alcohol level was above the legal limit.

The Miami Beach Police Department refused to confirm the reports. Ed Griffith, spokesman for Miami-Dade County prosecutor Katherine Fernandez Rundle, would say only that the investigation is focusing on whether alcohol was a factor in the death of 59-year-old Mario Reyes.

Reyes was struck and killed by a Bentley driven by Stallworth about 7 a.m. Saturday morning. Reyes, a crane operator, had just gotten off work and was trying to catch a bus when he was hit.

No charges have been filed against Stallworth, 28. His agent, Drew Rosenhaus, nor his attorney, Robert Switke, returned calls from The Associated Press seeking comment. Stallworth issued a statement Wednesday saying he was "grief stricken" over Reyes' death.

If Stallworth was drunk, he could be charged with DUI manslaughter which carries a maximum 15-year prison sentence.

Stallworth signed a seven-year, $35 million contract with the Browns as a free agent before last season but was injured much of the year. He previously played for New England, Philadelphia and New Orleans in the NFL and played college football at Tennessee.
