Arguing about DUI

Something needs to be done on the DUI laws. They should have a misdemeanor DUI charge where if you are over the limit but seem fit to drive you get a different type of fine and discipline.

Just recently in my area some dude was driving and started to go into road rage and busted through 3 red lights and hit three different cars. In one of the cars that he hit was a young little girl who was considered to be in serious condition. The cops however couldn't arrest the driver because he wasn't under the influence of any alcohol. They didn't even write the guy a ticket for reckless driving because if the girl should die they have to let the DA handle it. If she doesn't die only thing that will happen to him is his insurance company will raise his premium.

So let me get this straight if your brain is chemical free and you decide to go bumper cars on the streets you get to walk away but if you are shit faced out of your mind and don't know what you are doing and if you get behind the wheel it is a straight up felony. It just doesn't seem right to me.

Still call bullshit the guy just got away for that..and if you're over the limit why the fuck would you be fit to drive? Why risk that because some tough guy thinks he's sober enough to drive while under the influence. Makes no sense to have a different charge for it. If you're over the limit...you're over the limit....plain and simple.

Dude, not all DUI's are felonies, I am no attorney, but I believe a DUI is a felony only if there is injury, death, or if the driver had prior DUI's.
I am almost certain that if a driver has no history of DUI, gets pulled over for say a rolling through a stop sign, with no property or human damage, and blows say a .91, it's a misdemeanor, not a felony.

Regarding a sober driving with road rage playing 'bumper cars' I am sure he can be charged with reckless endagerment or something along those lines.

On a More Serious Note, we'll take advantage of this thread topic to remind the Reader At Large that when you elect to drive a motor vehicle after using alcohol the biggest danger is that you will bring harm to yourself. So exercise prudence every time you drink away from home.
